Terms for monthly and annual Fempire Academy memberships

These terms apply to your Fempire Academy membership. Fempire is a trading name of TLCH Consulting Pty Ltd ATF TLCH Trust, ABN 69 122 753 453.

Read them alongside the Website Terms of Use, the Cancellations and Refunds Policy and the Privacy Policy. Where you also purchase a program or certification, the Training Package Terms and Conditions apply to that purchase.

1. Your membership

1.1 What you get. Membership gives you access to the Fempire Academy learning environment and the resources, sessions and community areas included in your membership tier, as described at the time you join. Access begins when your first payment clears.

1.2 Personal to you. Membership is personal. You must not share your login, and you must not give any other person access to member content. Fempire may suspend or cancel a membership where login sharing occurs.

1.3 Content changes. Fempire may add, update, replace or retire content, sessions and features. We will not materially reduce what your tier provides without notice.

2. Fees and billing

2.1 Pricing. Membership fees are shown in Australian dollars and include GST where GST applies.

2.2 Recurring payment. Monthly memberships are billed monthly in advance and annual memberships annually in advance, to the payment method you provide, until you cancel. By joining you authorise those recurring payments.

2.3 Failed payments. If a payment fails, we will attempt it again and contact you. Access may be suspended while a payment is outstanding. Suspended time is not credited or extended.

2.4 Price changes. Fempire may change membership pricing on thirty (30) days written notice. A change takes effect at your next renewal, and you may cancel before then if you do not wish to continue.

3. Cancelling

3.1 How. Cancel at any time by emailing admin@fempire.com.au or through your account where that option is available. Cancellation takes effect at the end of the period you have already paid for.

3.2 Monthly memberships. You keep access until the end of the current month. Part months are not refunded, and past months are not refunded for non-use.

3.3 Annual memberships. You may cancel and receive a full refund at any time before you first access the member content. Once you have accessed the member content, the annual term runs to its end and is not refunded in part.

3.4 Rejoining. You may rejoin at any time at the price current when you rejoin.

4. Cancellation or suspension by Fempire

Fempire may suspend or cancel a membership immediately where fees remain unpaid, where these terms are breached, or where a member’s conduct is abusive, unlawful or materially disruptive to other members. Where we cancel for conduct, no refund is given.

Fempire may close the Academy or a membership tier on sixty (60) days written notice, and will refund the unused portion of any period paid in advance.

5. Community standards

The Academy is a working environment for women building businesses. As a member you agree to:

Treat other members, coaches and staff with respect
Keep confidential anything another member shares in the community or in a session
Not use the community to solicit or sell to other members without Fempire’s prior consent
Not record or republish sessions or member contributions
6. Intellectual property

Fempire owns all intellectual property in the Academy, including the methodology, frameworks, materials, templates, recordings and community content it publishes. You are granted a personal, non-transferable, non-exclusive licence to use the materials in your own business for as long as your membership is current.

You must not copy, share, resell, republish or create derivative works from Academy materials, or use them to develop or deliver any competing program, course or certification. Your licence ends when your membership ends, and you must stop using and delete downloaded materials.

Work you produce about your own business remains yours.

7. General information only

Academy content is general in nature and is not legal, financial, taxation, insurance or medical advice. Fempire does not provide financial product advice and does not hold an Australian Financial Services Licence. Fempire does not guarantee any particular business or financial outcome. Obtain your own professional advice before acting.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law. Where a right or remedy may be limited, Fempire’s liability is limited, at Fempire’s election, to supplying the service again or paying the cost of having it supplied again.

9. Privacy

Fempire handles your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Fempire Privacy Policy published on the Website.

10. General

10.1 Effective date and changes. These terms take effect on the date shown at the top of this document and apply to memberships taken out or renewed on or after that date. Fempire may update these terms, the version published on the Website applies from the date shown, and material changes will be notified to members.

10.2 Governing law. These terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of the courts of Queensland.
