How Fempire collects, uses, holds and protects your personal information

Fempire is a trading name of TLCH Consulting Pty Ltd ATF TLCH Trust, ABN 69 122 753 453, PO Box 643, Burpengary QLD 4505, Australia.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what we collect, why we collect it, who we share it with, and how you can access, correct or complain about it.

This policy covers information collected through our websites, forms, calls, events, programs and coaching, and through our certified and mentor coaches where they deliver a Fempire program.

This policy takes effect on the date shown above and replaces any earlier version.

1. What we collect

We collect only what we need. Depending on how you deal with us, that may include:

  • Contact and identity details: name, business name, email, phone, postal address, country and state
  • Business information you share with us during coaching, programs or applications, including goals, plans and financial information about your business
  • Transaction information: what you purchased, when, and payment status. We do not store full card numbers, which are handled by our payment providers
  • Program information: attendance, progress, coach notes, assessments and certification records
  • Communications: emails, form submissions, session recordings where you have been notified, and support requests
  • Technical information: IP address, browser and device type, pages visited, and cookie data

We do not seek sensitive information as defined in the Privacy Act. If you volunteer it, we will only use it for the purpose you provided it.

2. How we collect it

We collect information directly from you wherever possible: through forms, enquiries, bookings, purchases, calls, events and program participation. We also collect it automatically through cookies and analytics when you use our websites, and occasionally from third parties such as a coach who refers you, a partner event organiser, or a publicly available business listing.

You can deal with us anonymously or under a pseudonym for general enquiries. We cannot deliver a program, issue an invoice or grant certification without identifying you.

3. Why we use it

We use personal information to:

  • Deliver the programs, coaching, certification, memberships and products you have purchased
  • Process payments, issue invoices and manage payment plans
  • Respond to enquiries and provide support
  • Maintain certification records and the coach directory
  • Send you service information about programs you are enrolled in
  • Send you marketing about Fempire programs, events and resources, where you have opted in or where you are an existing client and have not opted out
  • Improve our programs, website and service, including through aggregated and de-identified analysis
  • Meet our legal, tax and record keeping obligations

4. Who we share it with

We do not sell, rent or trade your personal information. We share it only where it is necessary:

  • Fempire certified coaches and mentor coaches, where they are delivering a Fempire program to you, and only for that purpose. They are contractually required to handle your information in line with this policy and not to use it for their own marketing without your separate consent
  • Service providers who operate our systems, including our CRM, learning platform, email, scheduling, video conferencing, payment and bookkeeping providers
  • Contractors and virtual assistants engaged by Fempire, who are bound by confidentiality obligations
  • Professional advisers, where required
  • Law enforcement or a regulator, where required or authorised by law

If Fempire is sold or its assets transferred, client information may transfer as part of that business, and the acquirer will be bound by this policy or one materially equivalent.

5. Overseas disclosure

Fempire operates internationally and uses cloud based services. Your information may be stored or accessed outside Australia. The countries where recipients are likely to be located include New Zealand, the United States, the United Kingdom, Ireland and other European Union member states, Canada, Singapore, India and the Philippines, and other countries where our service providers, contractors or coaches store or process data.

Before disclosing information overseas, we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles, including through contractual obligations.

6. Marketing and your choices

We comply with the Spam Act 2003 (Cth). Every marketing email identifies Fempire as the sender and includes an unsubscribe link. You may unsubscribe at any time, and we will action it promptly.

Where you opt in to SMS notifications, you may cancel at any time by replying STOP. Mobile numbers and SMS consent data are not shared with third parties for their own marketing or promotional purposes. They may be shared with our support subcontractors solely to deliver the service.

Unsubscribing from marketing does not stop service messages about a program you are enrolled in.

7. Cookies, analytics and advertising

Our websites use cookies to operate the site, remember preferences, measure usage and support advertising. Analytics and advertising partners, including Google, may set their own cookies and may show you Fempire advertising on other websites based on your previous visits.

You can refuse or delete cookies through your browser settings, and you can manage Google advertising preferences through Google’s own settings. Some site features may not work correctly if cookies are disabled.

8. Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, including access controls, reputable providers and confidentiality obligations on our team and coaches. No system is completely secure, and we cannot guarantee absolute security.

We keep personal information only as long as we need it for the purpose it was collected, or as required by law. Financial and tax records are generally retained for seven years. Certification records are retained for as long as the certification is current and for a reasonable period afterwards, so that certification can be verified.

We destroy or de-identify information we no longer need.

9. Data breaches

If a data breach occurs that is likely to result in serious harm, we will assess it promptly and notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

10. Access, correction and complaints

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Email our Privacy Officer, Trudy Heins, at trudy@fempire.com.au. We will respond within thirty (30) days. There is no charge for making a request, though we may charge a reasonable cost for providing access in some cases. If we refuse access or correction, we will tell you why in writing.

If you believe we have breached the Australian Privacy Principles, contact our Privacy Officer, Trudy Heins, at trudy@fempire.com.au and we will investigate and respond within thirty (30) days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

11. Changes to this policy

We may update this policy from time to time. The current version is published on our website with the date it took effect. Where a change is material, we will tell you.
