Fempire’s Affiliate Program
Welcome to Fempire’s Affiliate Program’s Terms and Conditions!
The following terms and conditions apply to individuals or businesses who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.
By participating in the Program, the Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorised to register as an Affiliate or participate in the Program in any manner.
1. Approval or Rejection of the Registration
Fempire reserves the right to approve or reject ANY Affiliate Program Registration with our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
2. Affiliate Links
Affiliate links are automatically generated for you based on the unique Affiliate ID that you set up at the time of sign-up. You will have an Affiliate link for each product you’re authorised to promote.
You may use graphics and text links on your website, within your email messages and on social media. You may also advertise the Fempire product in online classified ads.
To be eligible to receive a commission payment for the sale of a product, you must use your unique affiliate link.
3. Cookies
We use a cookie to track people who have clicked on your affiliate link.
If a person doesn’t allow cookies or clears their cookies, then we can’t track them and so can’t pay earnings on that person’s activity. This is beyond our control.
We operate on a first cookie basis. This means that if you refer a customer to an affiliate product but they do not purchase straight away, then they return to the product and purchase through another affiliate’s link, you will receive the payment so long as the cookie you provided has not expired.
Cookies are set to expire after 3 months. The first day of tracking will start from the moment a customer clicks on the affiliate’s link.
4. Commissions and Payment
Each product has its own commission structure, which will be made known to you at the time of sign-up. If the product has an upsell product, the affiliate may also be entitled to receive a commission on that upsell should it be added to the customer’s purchase.
If an Affiliate Program product with a recurring subscription is purchased through an Affiliate’s link, the Affiliate will be entitled to a commission on each successful recurring purchase until the customer cancels their subscription.
Affiliate commissions are paid automatically after 60 days through PayPal. To receive payment, Affiliates must connect a PayPal account to their Affiliate account.
Payments will only be sent to Affiliates for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.
5. Promotional Material
Fempire may share promotional media such as swipe text, banners, logos or other specific promotional material to you through the Promo Materials tab under each approved Affiliate product. You can download the media or get the HTML embed code in order to share on Affiliate channels should they be provided.
6. Removal from Referral Program
Fempire reserves the right to terminate ANY Affiliate Program Account with our sole and absolute discretion. You will have no legal recourse against us for the termination of your Affiliate Program Account.
7. Term of the Agreement
The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.
The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.
8. Indemnification
The Affiliate shall indemnify and hold harmless Fempire Group Pty Ltd and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorised by Fempire Group Pty Ltd to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.
9. Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Fempire Group Pty Ltd affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Fempire Group Pty Ltd affiliate application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
